Criminal charges filed against a legal entity and an individual from Radoviš for multiple criminal offences related to a public procurement procedure and the transport of firewood

 

The Strumica Sector for Internal Affairs – Radoviš Police Department has filed a criminal complaint with the Basic Public Prosecutor’s Office in Radoviš against S.K. (43) from the village of Dedino, Municipality of Konče, on suspicion of committing the criminal offences of “abuse of the procedure for a public call, awarding a public procurement contract or public-private partnership,” “abuse of official position and authority,” “special cases of document forgery,” “use of a document with false content,” and “performing public transport without a license.” A criminal complaint was also filed against a legal entity from Radoviš, suspected of committing the offences “abuse of the procedure for a public call, awarding a public procurement contract or public-private partnership,” “special cases of document forgery,” and “use of a document with false content.”

S.K. and the legal entity of which he is the manager, following a previously announced public procurement tender issued by the Municipality of Radoviš and the decision selecting them as the most favorable bidder for the supply of beech firewood for the needs of primary schools in the Municipality of Radoviš, knowingly violated the rules of the procurement procedure by failing to fulfill the obligations from the contract. Specifically, instead of supplying beech firewood with a diameter range of 7–16 cm, they delivered poplar, wild pear, mulberry, alder, and beech wood with a diameter of 3–7 cm to the branch schools in the villages of Kalauzlija, Kodžalija, Injevo, Suldurci, and Pokrajčevo. In this way, they obtained an unlawful financial gain of 628,224 denars.

Additionally, the delivered firewood was not stamped with the official forestry marking seal for wood assortments and did not have a transport document for the transport of wood assortments for poplar, wild pear, mulberry, alder, and other types of wood, which indicates that the wood was illegally obtained. The reported individuals prepared fictitious delivery notes for the primary schools by entering false information in the section specifying the type of wood and type of wood assortment. In the column “responsible person,” S.K. signed the documents even though he was not authorized to do so.

Regarding the transport of the wood, S.K. carried it out using a cargo vehicle belonging to the legal entity without possessing a license for performing public transport.
