Department for Misdemeanors

HISTORY

In 2005, the Assembly of the Republic of Macedonia adopted constitutional amendments, which for the first time allowed that, in cases defined by law, administrative authorities could impose sanctions for misdemeanors in addition to judicial bodies. The decisions of such authorities are subject to judicial review under conditions and procedures regulated by law.

In May 2006, the Law on Misdemeanors was adopted, thereby completing the legal framework of penal legislation. This law established a clear distinction between the competences of courts and misdemeanor authorities and introduced numerous new legal institutions, reflecting its reformist character. Among other goals, the law aimed to reduce repression and increase prevention. This was achieved through new institutions such as mediation, settlement, and issuance of a payment order. This law served as the legal basis for the further development of misdemeanor bodies within the Ministry of Interior (MoI).

The Misdemeanor Sector was established in March 2007 as a new organizational unit within the Ministry. The Ministry of Interior was the first administrative body to systematize this organizational form and the first to begin operating under and applying the adopted legal provisions. In 2015, this unit was upgraded to a higher organizational level and renamed the Department for Misdemeanors.

 

ORGANIZATIONAL STRUCTURE

The Department for Misdemeanors is a distinct organizational form within the Ministry of Interior and comprises two main sectors:

  • Sector for Misdemeanors – Skopje

  • Sector for Misdemeanors – for the territory of the Republic of North Macedonia.

The Sector for Misdemeanors – Skopje includes the following departments:
Skopje 1, Skopje 2, Skopje 3, Skopje 4, Skopje 5, Skopje 6, and Skopje 7.

The Sector for Misdemeanors – for the territory of RNM includes the following departments:
Kumanovo, Veles, Kavadarci, Prilep, Bitola, Gevgelija, Shtip, Kochani, Strumica, Tetovo 1, Tetovo 2, Gostivar, Kichevo, and Ohrid.

 

COMPETENCIES

According to the Law on Misdemeanors (Official Gazette of the Republic of Macedonia no. 96/2019 and no. 253/2023), it is specifically determined that the misdemeanor authority conducts proceedings when exclusive jurisdiction for such action is prescribed by law. For proceedings against a legal entity, the competent authority is the one located at the registered seat of the legal entity. In cases of jurisdictional conflict between the courts and misdemeanor authorities, the Supreme Court of the Republic of Macedonia decides.
